Why take this course?

Intellectual Property is Most Sought After Field

Did you know that in 1991, 85% of corporate assets were in physical form, such as buildings, automobiles, equipment, raw material etc. In 2016, 85% of corporate assets are in intellectual form such as patents, copyrights, trademarks, goodwill, name brand recognition and so on. This means that corporations are spending a lot of money to acquire and protect their patent rights. This in turn means that there is a tremendous demand for professionals with IP background and credentials. Patent Lawyers make an average of $180K USD per year and that number goes up to $280K per year in areas like Silicon Valley, New York and such.

To become patent agent or attorney, you must pass Patent Bar Exam administered by USPTO. This course is designed to prepare the students for the Patent Bar Exam offered by USPTO (United States Patent and Trademark Office). Patent Bar Exam is considered to be one of the hardest licensing exams and I can confirm that since I have taken over two dozen such certification and licensing exams over my career. Though it is an open book exam, there are over 6000 pages of material covered in the exam. Furthermore, exam questions are designed to test candidates' understanding of the subject matter and not necessarily their ability to find the subject matter in the exam material available during the exam.

Student quote related to this course:

"Hey Kasey! I'm using the OmniPrep patent bar course, and supplementing it with your course. I must say, I am thankful that I had a solid understanding of the patent fundamentals prior to your course. I'm halfway done at the moment, and each question makes me realize "WOW.. I thought I knew this.. but not in this insane level of detail!" I'm hopeful to pass the exam and would love your guidance to help me along the way. Thank you! The course rocks and I hope to finish this weekend. :D

Hey! I just finished your class and wow.. amazing!! I wish you did more for the Patent Bar!!!!!! I want to do more questions (variations of the ones you taught), and others. I'd love to engage with people so I can pass this test. Thank you!"

  3. AIA 112, new matter
  4. Appeal process
  5. Reissue of patents
  6. Supplemental examination of patents
  7. Patent Prosecution Highway (PPH)

Layout & Approach

The course is laid out in question and answer format. The first lecture introduces you to the entire course and gives you a high level view as to what to expect in the course and how to best prepare and pass this very difficult exam. Each question is presented in a quiz format, which I call "Hot Pencil Drill." Before you answer hot pencil drill question, I have provided you pointers as to MPEP and other related material that you should review it quickly. This will help you hone in your MPEP search skill.

You will then answer a hot pencil drill question and see whether you got it right or wrong. Next lecture contains the answer in two formats - PDF attachment and video. You should carefully study the answer and watch video at least twice. Use the bookmark feature available on Udemy's platform to help you review important information at a later time.

Go through all 30 hot pencil drill questions, answers, videos, and related reference material. Make and update your outline while you go through these material.

Video Answers

Video answers are given in two formats - Screen cast video and talking head recap videos.

Screen cast videos walks you through each question, call of the question, answer choices, key issue(s), right answer reasoning, wrong answer reasoning, and more information. I have used John Madden style NFL game analysis markers to drive home the point of each question. In actual exam, you should be using highlighting feature, now available in actual patent bar exam at Prometric testing centers.

Talking head videos recaps the key issue and substantive patent law reasoning for each question to ensure that you fully understand why the right answer is right and related patent law and patent prosecution processes involved at USPTO.

Mentoring

Throughout the course, you are encouraged to participate in one or more of ten methods of communication with me and other fellow candidates, who are also going through their patent bar exam preparation journey.

The transcript of the first lecture is not correct in some areas and needs to be edited by the author.

this format is really helpful in habit forming and actually making me take the time to do it. My plan is to go through all the material once somewhat quickly, then use that foundation to study more, then return and check my ability on the quizzes again. The videos are immensely helpful and make it possible for me to study after a long day of work

It took a few sessions to pick up the benefit of the format, which as you work through the topics and specific search readings is quite an effective learning tool.

Mr. Shah immediately reminded me of my graduate professor for Finite Element Methods in that he is a proponent of the students success and fluid understanding of the material.

One of the few easily available courses that covers AIA rules. Good quiz questions. Good explanation of the principles underlying the structure of each question

The course was very helpful as the instructor provided in-depth explanation for some important topics such as AIA 35 USC 102, appeal process, PCT, objections vs. rejections, etc. Once you understand the points, it's easy to solve many long questions (in past exams) as you already know what knowledge the questions want to test and then you can just focus your reading on particular parts of the questions. I hope there could be more topics covered by 30 questions. The current questions are repetitive, for example, there are 3 questions that focus on the same aspect of the "new subject matter" topic. Anyway, great course and great instructor. I'd recommend every one to take the course to strengthen their understanding about the law and rules before taking the exam.

I definitely found this course to be worthwhile, especially since I did not enroll in any other formal MPEP course. If, like me, you have no prior experience with the MPEP or being a practitioner, the course will be useful in getting you on the same page with what kind of information is expected to be known for the exam, and how the questions will be asked. However, you should also refer to outside material (e.g. MPEP directly, UPenn patent law video lectures, and Patently-O/Finnegan/etc articles). For me, I also found it critically useful to go through at least one of the old (2003 or earlier) MPEP exams, despite them being quite outdated (and therefore more difficult in my opinion). I took the exam and passed. Going into the exam, I felt that I had a general idea of the 'spirit of the law', even though I was unsure on many of the exact details. This required me to reference the MPEP on pretty much every question (even if just to double check). Therefore, despite advice that you shouldn't go through the MPEP line-by-line (which I generally agree with due to the difficulty in absorbing the dense and disjoint sections), my life got a lot easier once I actually took the time to actually understand the organization and general content of each chapter (esp. 700 and 2100). Note that you will rely heavily on referencing the actual statutes (35 USC) and rules (37 CFR), so it also doesn't hurt to get friendly with the MPEP L/R Appendices, but thankfully the laws/rules are usually reproduced in the relevant MPEP sections.

Highly recommend. Very useful and the first of its kind, that I've found! I like quiz questions to reinforce learning.

It is a wonderfully organized course. I have been studying for USPTO exam for a few weeks now and this course has helped me a lot. The course is formatted in a way that it provides you preparing material very precisely, this has saved me a lot of time that I could have wasted browsing through MPEP. The follow-up video explaining why the correct answer is correct also help you understand the material rather than guessing. The prompt response and support by the instructor are also very helpful. I highly recommend this course.

Very informative and helpful. I did think there would be some additional resources that weren't just MPEP chapters, but an overall very good course that has been extremely helpful. If I were to make some recommendations on resources, I would say to make some quick graphics/diagrams that the instructor typically draws to illustrate various processes. These are very helpful and could be more useful on the front end of the questions as they help to understand the flow of certain MPEP chapters. Additionally, it would be much easier to refer to them while explaining the answers instead of the instructor's drawings. I know this seems knit picky, but hey, the instructions said to leave actionable feedback. Regardless, this is a great course and I would highly recommend it.

Excellent course! The quizzes are thought provoking and they hone in on the details of the MPEP that would otherwise be difficult to grasp. I now feel much more familiar with 35 USC 102 and 103 and other relevant provisions. I especially liked the last lesson, for it provided a superb review and summary of the entire course. Thank you, Kasey, for all you do to help others pass the patent bar. Sincerely, W. M.

I have just scratched the surface of this course and I am loving it already. Kasey Shah is so passionate about sharing his expertise, it comes through in every lesson. His method of eliminating incorrect answers so that you are left with the correct answer is brilliant. I would use it for patent questions but on many other subjects as well.

Thank you so much for creating this course! It is extremely thorough and complete. To anybody taking the exam, this course will help you without any doubt. The price is very low for the value you get from this course. There are so many resources to help you, from quizzes to pdf's and more. Luckily, it is lifetime, so you can always go back and check again and learn more! Also, the way the instructor, Mr Shah, talks is very very clear and pleasant to listen to. I love the background in his video's as well. Very much recommend this course! And Thank you again for all your effort to help us, students! Rachel Smets
